Cannabis FAQ

• Can the City limit the number of cannabis retail locations in Eden Prairie?

  The State of Minnesota allows cities to limit the total number of retail cannabis licenses to one per 12,500 residents, and there are approximately 65,000 residents in Eden Prairie.

  Per City Code Chapter 5, Section 5.81, up to five cannabis retail businesses are permitted to operate in Eden Prairie.

• Can the City regulate the hours of operation for cannabis retail stores?

  Yes, per City ordinance, cannabis retail establishments may operate daily from 10 a.m. to 9 p.m.

• Do cannabis retailers need a license from the City to operate legally?

  Per City Code Chapter 5, Section 5.81, cannabis retail businesses must first be licensed by the state's Office of Cannabis Management.

  Once licensed, cannabis retail businesses must register with the City by contacting the Police Department.

• Is it legal to consume or possess cannabis in Minnesota?

  Yes. In 2023, the Minnesota legislature enacted State Statute Chapter 342, which provides for the regulation of cannabis use, possession, production and sales.

• Is smoking cannabis permitted in City parks?

  No. Per City Code Chapter 5, Section 9.42, smoking or vaping any substance is prohibited in City parks.

• What is the minimum age permitted by law for smoking or consuming cannabis products?

  Adults ages 21+ are permitted to smoke or consume cannabis where permitted by law:

• Where can cannabis retail sales occur?

  Licensed cannabis retail locations are permitted in areas of Eden Prairie zoned as "retail" per City Code Chapter 5, Section 5.81.

  The retail locations must comply with the following minimum buffer requirements, measured from property line to property line:

  • Cannot be located less than 1,000 feet from a school
  • Cannot be located less than 200 feet from another cannabis retail business

• Where is smoking cannabis permitted?

  In 2023, per MN State Statute Chapter 342.09, the State of Minnesota legalized personal adult use of cannabis use in the following locations:

  • Private residences
  • Private property, unless prohibited by the owner
  • In premises licensed for on-site consumption

   

  In addition, per City Code Chapter 5, Section 9.42, the City of Eden Prairie permits smoking or vaping in the following locations:

  • Designated outdoor areas of City facilities
  • City streets, easements, sidewalks and trails, except when adjacent to or within City parks
