City Council and Planning Commission meetings take place at 7 p.m. in the Council Chambers at City Center.

These dates are intended to serve as a guideline of potential meeting schedules for complete application packages. Application packages received on the dates listed below are not guaranteed to be scheduled for the corresponding listed meeting dates. If an application package is incomplete and/or staff comments need to be addressed, meeting dates will be adjusted. Complex projects may require additional review time.

An important step in the review process is the initial meeting with City staff to discuss the land development proposal.

Incorporating staff suggestions regarding City policies and issues into further refinement of the plan will help minimize potential delays and problems later in the review process. Before meeting with City staff, you should do the following:

Review the following City Code chapters and policy documents:

• All Projects: Review zoning standards in City Code Chapter 11 and the City’s Design Guidelines document [PDF].
• Projects that require platting: Review City Code Chapter 12, which outlines rules for subdivisions/platting.
• Multi-family Projects: Review City Code Chapter 13 for affordable housing requirements.

Prepare conceptual (sketch) plans that illustrate your land development proposal in relation to items such as existing and surrounding land uses, wetlands, environmental features and City services, such as sewer, water, storm drainage, streets and historic sites.

Watershed District and Other Agency Reviews

Eden Prairie is located within the three (3) watershed districts listed below. Applicants should meet directly with the appropriate watershed district for information on their respective regulations, review processes and required permits early in the process. Permit review and issuance by watershed districts is an independent process in addition to City review and permitting.

Other departments and agencies that may review land development proposals are included below with contact information. It is recommended to contact these agencies (where applicable) early in the review process to determine if a permit is required and incorporate those requirements into the plans. City staff will also distribute submitted plans to relevant outside agencies as needed.

In addition to these agencies, residents will have an opportunity to provide feedback on projects at neighborhood meetings and public hearings. More information on neighborhood meetings can be found in "Phase 2" described below.

The details for each step in this flowchart are outlined in this handbook.

The City of Eden Prairie uses ProjectDox for application submittal and review.

Please refer to the Applicant ProjectDox User Guide [PDF] and the Electronic Plan Submission Naming Guidelines [PDF] document prior to submission. The following information must be submitted:

1. Email Land Development Application and Deposit Agreement [PDF] to Planning@edenprairiemn.gov. After application form is received, applicant will receive an email to submit electronic drawings and supporting documents via ProjectDox. The applicant should be the individual responsible for uploading documents and distributing city comments to the applicant team.
2. Submit application and deposit fees. Payment must be made via check payable to City of Eden Prairie to the attention of the Planning Division. Please also include the project name.
3. Upload current title information within the last 6 months for the property. Note: the City Attorney may require an updated title commitment prior to the City Council meeting.
4. Upload Project Narrative and any supporting documents.
5. Additional materials are required as part of a complete application. Refer to Applicant Checklist [PDF] for a full list of required materials.

Upon receipt of application materials, City staff will determine the completeness of the application package, identify major issues, recommend plan changes and request any additional information.

Comments from staff review will be provided to you in response to your submitted application. The City will respond to application submittals and resubmittals within 15 business days.

When comments are received, the applicant is expected to incorporate these comments into the project plans and resubmit revised plans and documents for review. Scheduling for Planning Commission/City Council review is based on the following criteria:

• Completeness of the application package and plan requirements
• Agenda availability
• Adequate time for public hearing publication and mailed notification to surrounding property owners as required by City Code and State Statute
• Identification and resolution of items that may cause a project to be continued or denied

If your project is adjacent to a residential neighborhood, involves high or medium-high density residential, or a Comprehensive Plan or zoning map amendment, it is expected the applicant will conduct a neighborhood meeting.

A well-attended neighborhood meeting is to your benefit as an applicant. This is an opportunity to identify neighborhood concerns so comments can be incorporated into the plans. It is recommended that the neighborhood meeting be scheduled early in the process, at least 4 weeks before the intended Planning Commission public hearing. However, it is also important to get feedback from City staff on any conceptual plans prior to sharing such plans at a neighborhood meeting.

Please work with City staff to determine the most appropriate time to schedule this meeting. A presentation should include the flow chart above to help the neighborhood understand the development review process. After the meeting, the developer should prepare a written summary of the meeting, including how many people attended and what comments were made by the neighbors.

If necessary, the City has rooms available for neighborhood meetings. Contact the Community Center to reserve a meeting room, or submit a room rental request for a City Center meeting room.

Contact Amy Mitchell in the Planning Division at 952-949-8485 to obtain mailing labels at least one week prior to your neighborhood meeting notification mailing date. Your mailed invitation should include:

• Date, time and location of the neighborhood meeting
• Name and description of the proposed project
• Contact name, phone number and email address of someone from the development team

The notice should be shared with City staff.

In 1995, the Minnesota Legislature enacted Minn. Stat. 15.99, also known as the "60-day Rule."

The 60-day Rule requires that an agency "must approve or deny within 60 days a written request relating to zoning, septic systems, or expansion of the metropolitan urban service area for a permit, license, or other governmental approval of an action."

A request must be submitted in writing to the City on the Land Development Application Form. Upon receipt of application materials, the City has 15 business days to respond to application materials. This response letter will be provided to the applicant. The response letter will address completeness of the application, substantive review comments, and potential scheduling of public review.

The 60-day review period begins the day the City receives a complete application submittal, including all required forms, payments, plans, and other required documents. If the City determines that an application submittal does not contain all required information, the 60-day review period starts over.

The City may extend its 60-day review period up to another 60 days by providing a written notice of extension to the applicant prior to the expiration of the 60-day time period. The City may take up to 120 days to review a preliminary plat application.

The applicant may grant an extension to the 120-day review period prior to the expiration of the 120-day time period in writing

Plans, drawings, and reports submitted in connection with development applications may be posted to the City of Eden Prairie website for review and comment by the public and will be included as a part of agenda materials for the Planning Commission and City Council.

Use of copyrighted plans and drawings in preparation for review and comment in public meetings and hearings on proposed development is constituted as reasonable "fair use" under Federal copyright law.

Applicant’s contact information, including phone and email, will be posted on the City website.

The applicant and owner agree that City officials may enter the property for purposes of inspection.

The applicant and owner also understand and consent that City officials may post a development sign on the property for the purpose of public notification that a land use application is under review for the property. This sign must be displayed until it is removed by the City.

For many projects, the first public meeting takes place at a Planning Commission meeting.

A public hearing notice is sent to all property owners within 500 feet (at a minimum) of the subject lot(s). A staff report is prepared once an application has been scheduled for a meeting. The staff report, project narrative and plans are distributed to Planning Commission members prior to the scheduled meeting. The Planning Commission typically meets on the second and fourth Mondays of the month.

At the conclusion of the public hearing, the Planning Commission ask questions and provide feedback to the applicant. Ultimately, the Planning Commission votes to recommend approval or denial of the request. The Planning Commission may also vote for a continuance if it is determined that more information is needed from the applicant in order to make a decision or informed recommendation. 

Projects may also be referred to other City commissions, such as the Heritage Preservation Commission, when applicable.

Once the Planning Commission, and any other relevant City commissions, have reviewed the project and made recommendations, the application package is reviewed by the City Council.

This generally occurs within 30 days of a Planning Commission action. The City Council typically meets on the first and third Tuesdays of the month September–May and once a month June–August. Similar to the Planning Commission meeting, a public hearing takes place at the City Council meeting.

Prior to the City Council meeting the applicant is required to submit the following items:

• 10 sets of the project narrative
• 10 sets of plan sets, scaled and printed on 11 x 17 paper, FOLDED, COLLATED AND STAPLED
• 10 sets of color renderings, unless waived by staff 
• A PowerPoint presentation is expected by the applicant (or their designated representative) at the City Council meeting and must be provided by noon Monday prior to the City Council meeting date.

At the time the City Council approves the development application package at the 1st reading, City staff are directed to prepare a Development Agreement to formalize the approval and any applicable conditions.

The Development Agreement outlines the responsibilities of the developer on specific items including, but not limited to streets, grading, stormwater management, landscaping, architecture, phasing, sidewalks/trails, maintenance, utilities, sustainability and water quality. An applicant developer should anticipate a 45-day process to draft, distribute, review, amend and sign the Development Agreement.

The applicant and the current owners (if these are different entities) must provide one (1) signed and notarized copy of the Development Agreement to the Community Development Department six (6) working days prior to the scheduled City Council meeting.

Once the Developer has signed the Development Agreement, the project is scheduled on the consent agenda at the next City Council meeting. The Developer is not required to attend or make a presentation for consent agenda items. The City Attorney files the approved Development Agreement with the County.

The Final Plat requires a separate application form and fees.

The Engineering Division reviews and processes final plat applications after preliminary plat approval. If the project requires a Development Agreement, the Final Plat is scheduled simultaneously or after Development Agreement approval.
